You’ve probably seen this ad. It plays on the fears of every person, keeping your family safe. However, this ad proposes that Hillary Clinton will “take away your guns” and that is just absurd. This argument has been ongoing for YEARS.
In case you’re not familiar with the second amendment, here it is:
On September 9, 1789, the Senate passed: “A well-regulated militia being the security of a free state, the right of the people to keep and bear arms shall not be infringed.”
So, what does this mean for us in 2016? In short, Hillary CAN NOT unilaterally take your guns away. As a part of the Constitution, for the Congress to unrecognize that right, the Second Amendment would have to be repealed. No simple legislation can do this. Congress writes laws based on the outlines and limitations in the Constitution, but cannot rewrite the Constitution itself except by a difficult process found in Article V of the Constitution:
The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article**; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate.”
What this means is that either two-thirds of all legislators in the House of Representatives and in the Senate must approve by cameral rules any proposed change to the Constitution, OR that two-thirds of the (currently) 50 states’ legislative bodies or a convention of them, any proposal to amend the Constitution. While the two-thirds majority approval to propose amending and only 33 such proposals actually made it through all the Congressional debates and votes to make it out of Congress to the states for ratification.
Not to mention that “We the people” hold a lot of power. Our government isn’t going to broadcast that fact. We can actually scrap our government and start over. No, that’s not treasonous, it’s within our rights as a country.
In short, these ads prey on the fears and ignorance of our laws to sway elections. I’m not telling you that you should vote for Hillary, I’m not saying you should vote for Trump. What I AM saying is that these ads on both sides are meant to play on your fears. Don’t let them. If you see an ad, instead of taking it as gospel, go to Google and look it up.
